Right of withdrawal
1. If the Buyer is a consumer within the meaning of the Consumer Rights Protection Law (PTAL) "Individual who expresses a wish to acquire, acquires or is likely to acquire or use a product or service for a purpose not related to his economic or professional activity" who concludes a distance contract makes a purchase in the online store FotoBarons.lv, the consumer may use the right of withdrawal and unilaterally withdraw from the contract within 14 calendar days of acquiring possession of the products (moment of delivery) without giving a reason.
The buyer cannot use the right of withdrawal if the product is made according to the consumer's instructions or the product is clearly personalized.
Also, the right of withdrawal cannot be used if the product delivered by courier have been mechanically damaged (scratches, abrasions, dents, etc.) and this was not indicated at the time of receipt of the product.
At the time of receipt, please make sure it matches what you ordered. If you notice obvious damage to the packaging or the product, insist that the courier record them in the delivery note of the product - this will help to determine whether the product is damaged during delivery! If the product has damaged packaging or it seems suspicious, you have the right not to accept the product at the time of delivery.
2. The buyer shall be responsible for diminished value of the goods if the goods have been used for purposes other than ascertaining the nature, characteristics and functioning of the goods.
Please note that during the period of using the right of withdrawal, you have the right to use the product to the extent necessary for the inspection of the product - to the same extent as it could be done before purchasing the product in a regular store!
3. When using the right of withdrawal, the buyer is responsible for the use of the product more than necessary for the purpose of the inspection and for the use of the product during the period of using the right of withdrawal, incompatible with the principle of good faith, or significantly damaged packaging.
We recommend that you keep the original packaging of the product, so that when using the right of withdrawal in accordance with the terms of the Distance Contract, the product would not be mechanically damaged externally. FotoBarons.lv keeps the right to charge a compensation fee or refuse to accept a product that is damaged, not in full set, or otherwise lost its original appearance. Proof of purchase (invoice, check or receipt) must be saved to use the right of withdrawal.
4. In order to use the right of withdrawal, you must inform SIA MINAPA, legal address Kr.Barona iela 32, Riga, LV-1011, phone +371-67284221, e-mail salons@minapa.lv about the decision to withdraw from this agreement with a clear notice, for example, using the sample Withdrawal form. To comply with the time limit for the right of withdrawal, the notification of the use of the right of withdrawal must be sent before the time limit of the right of withdrawal.
5. If you use the right of withdrawal and it is not related to the non-compliance of the relevant product or service with the terms of the contract, You must return the product to SIA MINAPA to the address Kr.Barona iela 32, Riga, LV-1011 not later than 14 calendar days after submitting the notice of withdrawal (sending a completed withdrawal form) and cover the direct costs related to the return of the product (unless you have agreed otherwise with the FotoBarons.lv representative).
6. If you use your right of withdrawal, online store FotoBarons.lv is obliged no later than 14 calendar days from the date of receipt of your notice of withdrawal, reimburse you for all your contributions.
